Terms of Service

By clicking the checkbox following the statement, "I have read and agree with the terms of service." during the registration process or through my continued use of the Texas Listing Service (TXLS) website, I agree, as consideration for access to and use of the services available to me at the Texas Listing Service (TXLS) website, to make the representations and warranties, and abide by the terms and conditions set forth in the following Terms of Service Agreement:
  1. In consideration for becoming a member of TXLS, I agree to pay TXLS according to the service level selected during the registration process including any additional services requested outside of the normal level of service. TXLS may from time to time add additional services to the service selection at which time I may elect whether to subscribe to the new services. All fees are exclusive of any applicable sales, use, excise, or other tax. Charges will be invoiced based on the level of services selected and are due within 30 days of the receipt of invoice. Invoices may be sent either via regular mail or email. TXLS reserves the right to suspend service without notice if payment becomes delinquent. I agree to pay any costs incurred by TXLS for the collection of delinquent payments. I may cancel my service at any time by providing notice via regular mail or email.
  2. I am solely responsible for information sent or displayed by TXLS under my Member’s user ID and/or password, and I agree to indemnify and hold harmless TXLS for any claims arising against TXLS arising from any information submitted to TXLS. I irrevocably grant to TXLS all rights to the information submitted under my membership and grant permission to TXLS to reproduce and/or redistribute all or parts of information submitted.
  3. I agree that use of service is at my sole risk. TXLS and its affiliates do not warrant the accuracy, completeness, correctness, or suitability of purpose of any information available through the service. In addition, TXLS does not warrant the participation or compliance of members or non-members with TXLS or any other organizations. TXLS cannot and does not guarantee any specific results or improved performance to members or their affiliates. TXLS, at its sole discretion, may from time to time modify and or suspend any services it provides.
  4. I agree that by placing listings on TXLS I am certifying that I am a Realtor and acknowledge that I must maintain my Realtor status or risk having my membership terminated.
  5. I agree that by accessing sold information on TXLS that I am either a Realtor or a licensed appraiser with an active affiliation with a Realtor association.
  6. I agree to the following rules and regulations and understand that failure to comply with the rules and regulations may result in suspension of service or applicable fines:
    1. Members should make a reasonable effort to include at least one photo for each listing. Each listing should contain at least one unaltered photo that is suitable for use in a standard appraisal report.
    2. Members must have a current, signed exclusive right to sell agreement before a listing may be entered into the service. Members agree to provide copies of the signed exclusive right to sell agreements to TXLS upon request. Failure to provide copies may result in the termination of listings or suspension of service. Shared listings involving more than one Member are not considered exclusive and will be removed from the service.
    3. Inaccurate address information is prohibited. The address entered should be the physical street location and should not contain other information. Words such as reduced and other information not related to the physical location of the listing should not be entered in the address field.
    4. Entry of inaccurate location information such as subdivision or school district to increase exposure of the listing is prohibited.
    5. Entering false or misleading information is a violation of this service agreement and may result in termination of listings or suspension of service.
    6. All sales closed must be entered within 5 days of the actual closing date. There are no exceptions to this rule. If TXLS is used to market the property, the sale must be reported. Failure to report the sale of a listing will result in a $150 charge to your account. In addition to an accurate sales price and closing date, all comparable sales should include the following in the closing comments for the listing:
      1. Buyers Name
      2. Sellers Name
      3. Valid Tax ID Number and Address unless one does not exist
      4. Seller Concessions: (seller paid points/closing costs, repairs, rebates or other financial assistance)
      5. Financing terms: (cash, conventional, FHA/VA or seller, including loan to value percentage, interest rate and term)
    7. Your member login and password information is confidential. You are responsible for its use. Is should not be shared or otherwise disclosed to any other person except for individuals directly associated with your office. Should TXLS determine that there has been improper dissemination or use of this information you will be subject to immediate suspension of service.
    8. Information not already available to the public through TXLS shall not be redistributed to individuals not directly associated with the Member’s office. Offering sold information to an appraiser that is neither a member of TXLS nor directly involved in the appraisal of a Member’s listing is prohibited.
  7. TXLS reserves the right to suspend or terminate service at any time without notice.
  8. All information available through the Texas Listing Service (TXLS) is the property of Dustin L. Davis and is protected by copyright, trademark and other intellectual property laws and cannot be redistributed without written consent. Information available or received through TXLS may be displayed and/or printed for personal, non-resale use only.
  9. I understand that, due to the nature of the TXLS service, TXLS is not able to provide any refunds for services purchased.
  10. This Agreement constitutes the entire agreement and is governed by the laws of the State of Texas.
